Privacy Policy — HaMarpea BeMaccabim Ltd

General

HaMarpea BeMaccabim Ltd, whose physicians specialise in ophthalmology, pulmonary medicine and aesthetic medicine (hereinafter: the "Clinic"), respects the privacy of users of the websites under its management as listed below, and of the additional digital platforms operated by the Clinic or on its behalf (hereinafter jointly: the "Site"; and the users thereof: the "Users").

The following is the list of websites to which this privacy policy applies:

Protecting the privacy of Users is important to us. This privacy policy is intended to clarify how information provided by you in the course of using the Site is collected, stored and used.

The Clinic may amend the provisions of its privacy policy from time to time, so as to reflect technological, commercial, legal or regulatory changes. Such updates will be published in this document, which will be available in its updated form on the Site. Use of the Site is subject to the privacy policy in force on the Site, and will evidence your consent to changes therein — the Clinic therefore recommends reviewing this policy from time to time.

Use of the Site constitutes consent to this policy, in all its parts, and to the use of information in accordance with its terms. If you do not agree to any of the terms of this policy, you are requested not to use the Site. This policy is written in the masculine form for convenience only, but is addressed to women and men alike.

This policy concerns use of the Site only. The privacy and confidentiality of personal and medical information collected in the course of receiving treatment at the Clinic are governed by the Patient's Rights Law, 5756-1996, the Privacy Protection Law, 5741-1981, and Ministry of Health circulars, and are set out in the Patient Privacy Notice.

It is clarified that medical information provided by you through the enquiry forms on the Site is subject to this policy until it is absorbed into the Clinic's systems, and from that point onward the provisions applicable to medical information as aforesaid shall apply to it.

Provision of Information

The Clinic may collect and store information regarding visitors to and users of the Site, whether transferred by them or collected by the Clinic as a result of and/or in connection with use of the Site, as set out in this policy.

Some of the services operated by the Clinic on the Site, for example the contact page, may require the User to provide personal details, such as: name, contact details (such as telephone and email), and an "open" message (which may include medical information) (hereinafter: "Provision of Information"). It is clarified that the User is not obliged by law to provide these details, and their provision depends solely on his wish and free consent. However, provision of some of them is required, in the sense that without providing them the User may be unable to carry out various actions through the Site. For example, without providing your contact details, we will not be able to respond to the enquiry you left on the Site (hereinafter jointly: "Provision of Information").

The information collected will be stored in the Site's database (hereinafter: the "Database") in accordance with the provisions of the Privacy Protection Law, 5741-1981, and will be used only for the purposes set out in this policy.

In addition to information provided proactively by the User during use, technical and statistical information is collected automatically for the purposes of analysis and improvement of the user experience, such as: IP address, browser type, device type, times of use of the Site, pages viewed and duration of stay. This information is collected by means of Cookies and other tracking files, as detailed in the Cookies section below.

The User declares that he is aware of and hereby consents to the information he has provided and/or which is collected about him in the framework of this engagement with the Clinic, and/or in the framework of his use of the Site and/or the leaving of enquiries (hereinafter: the "Data"), being stored in the Clinic's databases.

When using the Site and/or in order to make contact with the Clinic, the User may choose to make contact through social media channels or other services operated by external parties. Any enquiry through external platforms shall be made at the User's discretion and at his sole responsibility. It is clarified that use of these means may lead to exiting the Site operated by the Clinic and moving to an external site operated by a third party, to which the terms of use and privacy policy of that third party shall apply. From that stage, the Clinic and/or anyone on its behalf has no control over the use to be made of the User's information, and it shall bear no responsibility in relation thereto.

The User hereby declares and undertakes that all information he provides and/or updates on the Site and/or in any other manner is correct, reliable and accurate, and further that he has provided the information in his own name and for himself only, and not in the name of and/or for third parties, save in cases where he has been expressly authorised to do so. The information provided by the User, including in guest browsing mode and without a registration process, as well as further information which accumulates about him and his actions through the Site, shall be stored in the Clinic's database as detailed above, and shall be used in accordance with the purposes of the database set out in section (c) below, in accordance with this privacy policy and in accordance with the provisions of any law.

Purposes and Manner of Use of Information

The Clinic may collect and make use of information provided by the User in the course of providing his details in the framework of use of the Site, and/or of information which has accumulated about the User, including in the course of use of the Site, in order to operate, manage, improve, enrich or modify the Site (including modification of the Site as displayed to the User), and to provide the services and content offered thereon to patients and/or Users personally and/or to all or some of the Users of the Site. In addition, the information will be used for maintenance and improvement of the Site and the content displayed thereon, fraud prevention, operation, security, detection of fraud and/or any other unlawful activity. Furthermore, the information will also be used for responding to enquiries received through the Site, scheduling appointments, treatments or consultations, providing preliminary medical advice, and maintaining contact with enquirers as necessary. Statistical information provided to third parties will not identify the User personally.

Use of "Cookies" on the Clinic's Site

For the User's information, the Site uses cookies and information-gathering software (hereinafter: "Cookies") for its ongoing and proper operation, for securing the data thereon and the information you provide, and including in order to collect statistical data regarding use of the Site, for verification of details, to improve the browsing experience of Users while adapting the Site to their personal preferences, to facilitate their browsing on the Site, to characterise the products suitable for Users, to tailor relevant advertisements for them, including while browsing other sites, all for statistical, research and commercial purposes, and of course for information security purposes.

Cookies are text files which the User's browser creates upon instruction from the Clinic's computers. Some Cookies expire when the User closes the browser and others are stored on the hard drive of the User's computer. Cookies contain various information (see above in section 16) such as the pages the User visited, his IP address, the length of time he spent on the Site, from where he arrived at the Site, sections and information the User wishes to see upon entering the Site, and more. Cookies may also store information regarding the browsing habits of the visitor on other sites, including the sites on which he browsed, the pages on those sites and any other action thereon. The information in Cookies is encrypted, and the Clinic takes precautionary measures to ensure that only the Clinic's computers or those on its behalf will be able to read and understand the information stored therein, save as otherwise set out below.

The Site operates on the WordPress system, which may use technical Cookies (Session Cookies) required for the proper operation of the Site and the enquiry forms.

In addition, the Site uses the Google Analytics tool for statistical analysis of visitor traffic, fault detection and improvement of the user experience. Cookies which assist the Clinic in tailoring the browsing experience for you. Further information on these Cookies may be found on Google's site at https://www.google.com/intl/en/policies/technologies/ads/, and in Facebook's cookies policy at https://www.facebook.com/policies/cookies/.

Third-party measurement and advertising tools are embedded in the Site, including Google Analytics and the Meta Pixel. These tools transfer to Google Ireland Limited and to Meta Platforms Ireland Limited information regarding your browsing on the Site, including your IP address, cookie identifiers and the addresses of the pages you visited, including to servers located outside Israel, including in the United States. This information may be used by those parties to tailor advertisements for you, including on other sites and services. The basis for the transfer is your consent, which may be withdrawn at any time through the cookie settings on the Site.

Furthermore, the reCAPTCHA service of Google Ireland Limited is embedded in the Site, intended to verify that actions on the Site are performed by a human and not by automated software. For this purpose, information regarding your device and the manner of your use of the Site, including your IP address, is transferred to Google, including to servers located outside Israel. This service is essential for the security of the Site and for preventing misuse of the enquiry forms.

Cookies may be blocked or deleted through the browser settings, however blocking them may impair some of the Site's functions.

Disclosure of Information to Third Parties

The Clinic shall take reasonable and accepted measures in order to safeguard and prevent the transfer of personal details identifying the User by his name and/or identity details, such as the User's name and address, to third parties, save in the following cases:

• At the User's request and/or with his express consent;
• Where required for the operation of the services, such as service providers (cloud, enquiry management and contact with the Clinic, and provision of medical service);
• In any case in which the User has breached the terms of the privacy policy, and/or in cases in which the User or anyone on his behalf performed or attempted to perform, through the Site and/or in connection therewith, actions contrary to the provisions of the privacy policy, including the provisions of any law;
• Where the transfer of the User's details is required for the completion of a request and/or enquiry and/or provision of a service and/or transfer of payment;
• By reason of a judicial order instructing the Company to provide the information to third parties;
• By reason of any dispute, claim, suit, demand and/or legal proceedings conducted between the User and/or anyone on his behalf and the Clinic and/or anyone on its behalf;
• In any case in which the Clinic considers that provision of the information is necessary in order to prevent serious damage to the property and/or person of the Clinic, the User and/or third parties, or in order to prevent other serious damage at its sole discretion;
• Where the Clinic has transferred and/or assigned to a third party its activity and/or its rights and obligations towards the User, provided that such third parties assume the provisions set out in this policy.

Nothing in the foregoing shall derogate from the Clinic's right to transfer to third parties non-personal information which does not directly identify the User by his name and/or identity details.

Anonymous and Statistical Information

It is clarified that the Clinic makes use of any anonymous or statistical information which does not permit the identification of a person, and which was derived from the User's use of the Site and/or the services, for the Clinic's purposes and for any other purpose, including its transfer to third parties, subject to the provisions of any law. In any event, statistical and anonymous information transferred to third parties will not include identifying details of the User.

Information Security

The User is aware that reasonable and advanced security measures are taken, in accordance with accepted standards, for the purpose of protecting sensitive personal and medical information. However, no system is entirely immune, and the Site cannot guarantee absolute protection against intrusion or unauthorised use of information.

The Clinic will use protection and encryption measures customary in the operation of websites in Israel for online transmission of information, and as required by any law. Furthermore, the Clinic takes reasonable measures to protect the information, the Site and the hardware and software components connected with its operation, and ensures that they are updated on an ongoing basis, inter alia in order to protect the Site and its content against intrusions, breaches or unauthorised interception.

In addition, the Clinic keeps itself updated on an ongoing basis regarding technological developments in the fields of software and hardware in order to provide Site Users and its patients with the best protection against intrusion or hacking, including unauthorised entry into its databases. However, the Clinic clarifies that in cases which are not within its control and/or which arise from force majeure, it does not undertake that the Site will operate in an orderly manner, without any disruption, and/or that the Site and/or the data collected and/or provided on the Site or in the shops as stated above will be absolutely immune from unauthorised access and/or intrusion into the Clinic's databases, and the User is aware that the Clinic shall bear no liability for any damage and/or loss, direct or indirect, of any kind whatsoever, caused as a result thereof, including by reason of infringement of privacy.

Exercise of User Rights and Contact Regarding Privacy

Under the Privacy Protection Law, 5741-1981, you, or anyone on your behalf, are entitled to inspect personal information (as that term is defined in the Privacy Protection Law) about you which is held in the Clinic's databases, and also to request that the Clinic correct such information if it is incorrect, incomplete or inaccurate.

The Clinic is not obliged to provide information which is subject to a privilege established by law, save where the applicant is the person for whose benefit the privilege was established.

In order to exercise these rights, a written request must be sent to the Clinic, which is the controller of the database in which the information about you is stored, through the "Contact Us" tab on the Site, or alternatively contact may be made through one of the contact details set out in the sections below.

In any correspondence to the Clinic, you must include your full details, including a contact email address, and precise particulars of your request. The Clinic will endeavour to respond to any reasonable request in accordance with the provisions of the law.

The Clinic reserves the right to reject or accept your request. To the extent that the Clinic elects to accept your request, the Clinic will correct or delete the personal information as required and will update every party which received the personal information from it, within the period prescribed by law. If it elects to refuse the request, the Clinic will notify you of its refusal in the manner and by the means prescribed by law.
